Italian justice validates homoparentality
(Blogmensgo, January 25, 2013) The Court of Cassation Italy has confirmed, in a divorce, the custody of a child to be held by its mother while she is now in a relationship with a woman. The Supreme Court has dismissed the father, who challenged the placement of the child in a lesbian family.
The judgment of the Court of Cassation is explicit: it has never been scientifically proven that homosexual couples were not as capable as others raising children, and a fortiori they represented any danger to the Children. Not only "there is no scientific certainty or evidence, but [there is] simply a prejudice" against homosexual couples and children in the fact that "takes for granted what is actually demonstrated, that is to say, the harmful nature of the family context for the child, "said the Supreme Court in its judgment is motivating.
Flavio Romani, president of the Italian LGBT organisation Arcigay, welcomed this in a statement on the 11th of January 2013, stating this to be a "historic decision."
"It is love which raises a son or daughter, not the sexual orientation of the parents," said Flavio Romani. And clarify the scope of this new ruling: "A child raised in a family consisting of a mother and a mother, or a father and a dad, it's exactly the same thing that a child raised in a family consisting of a man and a woman. '
Romani called future Italian parliamentary majority - which will come after the general election of February 2013 - to legalize gay marriage as the full equal rights for all families.
Current social regulation is even more outdated, insists Flavio Romani, in recent years the Constitutional Court and the Supreme Court have repeatedly "said gay marriage is perfectly compatible with our Constitution."
