Socialist MEPs in France propose marriage for all, but without MAP
(Blogmensgo, 22nd January 2013) On January 9, 2013, The Socialist group in the National Assembly has waived to propose an amendment on medically assisted procreation (MAP) in the bill on marriage for all. PMA for homosexual couples is not abandoned so far, say members of the ruling party, but it will be included in a broader bill on the family.
The bill "marriage for all" that members must consider from 29 January, therefore aims to establish a homosexual marriage without including the essential elements that are LDCs and management for others (GPA).
This is the title of the draft Family Law - presented to Cabinet in March and the National Assembly before the summer - that will set a framing device for medically assisted procreation (MAP). It will then immediately set measures included in the bill, rather than a simple amendment. Invitro fertilization and artificial insemination could, in this context, be offered to unmarried women (regardless of their sexual orientation) and lesbian couples.
If the authorization of the GPA does not fully program the bill on family, parenting provisions and parentage (including GPA if overseas) are likely to be included in the future text.
The removal of the amendment to the MAP was requested by opponents of the bill. François Hollande and Prime Minister Jean-Marc Ayrault, too, wanted not include the LDCs in the bill on gay marriage. In theory, in order not to make amendment of the PMA - which would then concern only homosexual women - thanks to the censorship by the Constitutional Council for breach of the principle of equality. But also because the LDCs would be better placed in future legislation on the family.
